When booking at Beach Getaways Victoria you accept the following:

1. THE PARTIES. This Short-Term Rental Agreement IS made between the following:

The Guest and Beach Getaways Victoria on behalf of the property owner.

2. THE PROPERTY. The Owner agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Owner:

3. RENTAL PERIOD. The Guest shall be allowed to occupy the property for the designated booking period.

4. MAXIMUM OCCUPANCY. Only the number of persons specified in the booking are allowed to stay overnight. Any additional guests must be approved in advance.

If more than the authorised number of guests listed above are found on the Property, this Agreement will be subject to termination.

5. BOOKING FEES. The Guest shall pay the booking amount as detailed during the booking process.

6. SECURITY DEPOSIT. Amount as detailed in the booking process. The Security Deposit is for the faithful performance of the Guest under the terms and conditions of this Agreement. The Guest must pay the Security Deposit at the execution of this Agreement. The Security Deposit shall be returned to the Guest within 7 days of departure less any itemised deductions.

7. CHECK IN / CHECK OUT. Check in is after 4.00 pm, check out is 10.00 am. We do our best to accommodate flexibility but not guaranteed.

8. NOISE CURFEW. To respect the tranquillity of our neighbourhood and other guests, a noise curfew is in effect from 9.00 pm to 7.00am. Loud noise, music, or disruptive behaviours are prohibited during these hours.

9. PET POLICY. a. Pets are allowed on the premises with prior approval. b. We respectfully request that pets are not allowed to jump on beds, sofas, or other furnishings. c. Guests are responsible for cleaning up after their pets both inside and outside the property. d. Any damage caused by pets will be charged to the Guest.

10. NO SMOKING POLICY. Smoking is strictly prohibited inside the property. Designated smoking areas may be available outside. Please dispose of cigarette butts responsibly.

11. NO SCHOOLIES POLICY. We strictly do not allow bookings associated with "Schoolies" celebrations or large group student events.

12. NO CARAVANS/CAMPERVANS/MOBILE HOMES. Caravans/campervans/mobile homes are strictly prohibited on the property. If a caravan/campervan/mobile home is sighted, the guest will be asked to remove it immediately. Failure to comply may result in the withholding of the security deposit.

13. SUBLETTING. The guest does not have the right to sublet the Premises.

14. RUBBISH. Guests must dispose of their waste in the provided bins. Please separate recyclables from non-recyclables according to local guidelines.

15. QUIET ENJOYMENT. The Guest, along with neighbours, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilised manner and shall be good neighbours with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

16. HOUSEKEEPING. The property is to be left in a tidy state upon checkout. Excessive cleaning, beyond regular housekeeping, may result in additional charges.

17. DAMAGE. Any damage to the property or its contents must be reported immediately. Guests may be held financially responsible for any damages they cause.

18. AMENITIES. Please use amenities, including BBQ, and others, responsibly. Follow any posted guidelines or instructions.

19. USE OF PREMISES. The Guest shall use the Property for residential use only. The Guest is not authorised to sell products or services on the Property or conduct any commercial activity.

20. SAFTEY. Please be mindful of safety at all times. This includes supervising children, being cautious around water or fire features, and following any safety instructions provided.

21. ILLEGAL ACTIVITY. The Guest shall use the Property for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behaviour shall cause immediate termination of this Agreement with no refund of prepaid Rent.

22. CANCELLATION POLICY. If the Guest wishes to cancel the reservation, the deposit will be refunded as follows:

● 100% if cancelled [60 days] before arrival date.

● 50% if cancelled [30 days] before arrival date.

● No refund if cancelled less than [29 days] before arrival date.

24. LIMITATION OF LIABILITY. We do not accept any liability for any damage, loss, injury, sickness, or inconvenience to any Guest, pets or property, whether direct or indirect, and however caused.

25. INDEMNIFICATION. Guest agrees to indemnify and hold harmless VS Direct Pty Ltd and BeachGetaways.com.au from and against any liability for personal injury or property damage sustained by any person (including guests of Guest, and pets) as a result of any cause unless caused by the negligent or wilful act of the Owner.

26. GOVERNING LAW. This Agreement shall be governed by and interpreted in accordance with the laws of Australia and the State of Victoria.

27. ENTIRE AGREEMENT. This Agreement contains the entire agreement between the parties related to the subject matter hereof, and supersedes any prior understandings, written or oral, related to the subject matter hereof.

28. TERMINATION: Failure to abide by these rules may result in the termination of the rental agreement without a refund.

29. ACCEPTANCE. By making a reservation and payment, the Guest agrees to all terms and conditions of this Agreement.
